TERMS AND CONDITIONS OF PURCHASE

Access to and use of the website www.https://creatingbags.com/gb/packaging-textiles-as (hereinafter referred to as CREATING BAGS or "Online Shop"), as well as the purchase of its products are subject to the acceptance by the user of the TERMS AND CONDITIONS OF PURCHASE. Please ensure that you have carefully read all of the TERMS before making use of the services offered in the online shop.

Access to CREATING BAGS and the use of the services offered implies full acceptance of these TERMS AND CONDITIONS OF PURCHASE and our Privacy Policy.

The TERMS AND CONDITIONS OF PURCHASE may undergo changes over time, the user is recommended to always access them before proceeding to make a purchase. In the event of any change, CREATING BAGS will notify users through the Newsletter or other equivalent means.

1. USER REGISTRATION

You do not need to be registered to place an order. However, to access some of our services the user must register by filling out the registration form where you will be asked for personal information that must be updated and conform to reality. At the end of the registration process, the user must accept these TERMS AND CONDITIONS OF PURCHASE and our PRIVACY POLICY.

The user name and password must be kept in a safe place. Once you have obtained your username and password, you can access the menu item "My Account" (Login) where you can modify your registration data, view and monitor the status of your orders.

In case you detect any misuse of your registration information, please contact CREATING BAGS immediately via e-mail info@creatingbags.com.

If you have forgotten your user code and/or password, you can request them through the "Login" access where a link "Have you lost your password?" has been enabled. In this case, the system will send you an e-mail with a new randomly generated secure password. Once you have accessed your account, you will be able to change your password from the "Account details" option in the Change password section.

2. ORDERS

To place an order in our Online Shop you will need to enter personal information. In particular, your real name, shipping address, e-mail address and telephone number are required. You will also be required to enter your payment method information which must be valid and correct.

3. ORDER INTAKE

Once you have entered your selection of items and completed the order request process we will send you an email with details of your order. This email does not imply acceptance of your order, but merely constitutes confirmation that we have received your order request.

The acceptance of your order and the conclusion of the distance selling contract will take place when the shipment is made. The contract of sale is concluded in Spain and the language used is Spanish.

Orders are subject to acceptance by CREATING BAGS, the user's compliance with and acceptance of the TERMS AND CONDITIONS OF PURCHASE and the availability of the product ordered. CREATING BAGS reserves the option of not accepting the order in the event that the payment information is not approved, that the articles are not in stock, that the quality of the article is not acceptable, that transport problems to the required destination are foreseen, or that any other type of incident relating to the GENERAL CONDITIONS OF USE of the Online Shop is detected.

Items added by you to your shopping cart are not reserved and consequently any other user can purchase these items.

TEST OF A PRE-ORDERED UNIT

CREATING BAGS offers the customer the possibility of producing one or more sample units of the order, at a low cost and with a prior estimate, in order to be able to visualise and check the result of the final product in terms of materials, manufacture, printing, sizes and other characteristics of the chosen product.

The request for samples is optional at the sole discretion of the customers and must be requested prior to the confirmation and initiation of the final order. Requests for these samples will not be accepted once the final order has been initiated.

It must be taken into consideration that the request for samples in advance may delay or modify the delivery dates of the final order, as the order will not be started until expressly confirmed by the customer.

In the event that the customer does not request the unit test and verification of the chosen product, CREATING BAGS shall not be liable for any claims that may arise upon receipt of the final product in terms of finish, size, material, colour variation, printing or any other cause that could have been avoided in the event of requesting the initial and individual test of the product.

4. INTERNAL LABELLING

All textile packaging, when placed on the market, both in the industrial and commercial cycle, must be labelled in accordance with the legal requirements.

It is compulsory for the label on the packaging to contain the name or company name or denomination of the manufacturer or the customer and his address. In any case, the customer shall be solely responsible for the packaging and, therefore, for all infringements of labelling regulations.

CREATING BAGS offers the following possibilities for internal labelling:

Creating Bags offers the customer the option of purchasing the internal label in each of the product sheets, in complements for this product, these possibilities:

  1. Internal label with the data of Creating Bags and composition and maintenance data: No cost (free of charge).

  2. Internal label with the customer's brand name and composition and maintenance data: the cost of this label can be calculated in each of the product sheets, in complements for this product.

  3. Unbranded internal label "neutral label", with composition and maintenance data: this cost can be calculated in each of the product sheets, in complements for this product.

IMPORTANT NOTE

The containers are generally sold without any type of internal label, so it is the sole responsibility of the customer to proceed with the legally established labelling, the company being totally exempted Creating Bags of those packages that the customer does not label on the basis of legal obligations and has been informed on the basis of these conditions of purchase.

5. BCI CERTIFICATE

The customer shall apply to Creating Bags that the cotton from which the body of the chosen packaging is to be made is manufactured with BCI Certificate. The invoice will then include the BCI Certificate Transaction Number of the supplier of the material, not of the packaging manufactured by the supplier Creating Bags.

The customer's request for organic cotton must be made at the time of placing the order, indicating it in the Comments section of the order, or prior to payment, not being valid to do so at a later time. Any request made after the order has been placed cannot be modified and will be made with the materials usually used by Creating Bags.

BCI-certified material shall be used for the main part of the product, which may contain accessory parts that are not made of this material.

CREATING BAGS uses a secure payment gateway with encryption of payment data. Therefore, CREATING BAGS will not store in its files the information concerning the data of the cards used.

When using the debit/credit card, the user confirms that the card used is his or her own or has been duly authorised by the owner of the card for use. Credit/debit card transactions will be subject to a security and validation check by the card issuer. In the event that the card issuer denies the transaction, CREATING BAGS will not be responsible for delays or cancellations of shipments.

The prices of the articles applied in the online shop are represented in EUROS (EUR) and include the applicable VALUE ADDED TAX (VAT). In the case of Switzerland, Norway, Ceuta, Melilla, Andorra and the Canary Islands the shipment will be made DDU so the prices of the items are invoiced without VAT according to Law and you will be responsible for the payment of any applicable taxes or duties. In the summary of your order in the CONFIRMATION AND PAYMENT section you can review the prices excluding VAT attributed to your order.

The prices of the items entered are valued in EUROS. Payments and refunds for all shipments will be made in Euros (EUR). If your credit/debit card is not denominated in EUROS, the exchange rate will be applied by the relevant bank according to the market exchange rate.

Orders placed by customers making a purchase from the European Union will be shipped under DDP (DELIVERY DUTY PAID) terms which implies that the final prices include applicable taxes and duties. If the shipment has been made to a country with applicable duties (for example, the case of Switzerland, Ceuta, Melilla, and the Canary Islands) in the case of a return, the handling costs and the duties themselves will not be reimbursed. You will have to contact your nearest customs agent for the recovery of these costs.

In general, the prices of the articles reflected in the Online Shop do not include shipping costs. In the SHIPPING section, you will find information on the cost of transport assigned to each area or country and depending on the volume of your purchase or the promotion at the time, shipping costs may be free for the Peninsula or Balearic Islands.

All prices on our website are valid for 30 days and may vary without prior notice.

7. SHIPPING

7.1 DESTINATIONS, SHIPPING COSTS AND INSURANCE

Shipping addresses cannot be post office boxes. Shipments will be made in accordance with the conditions set out on the CREATING BAGS Shipping and Returns website.

Shipping costs vary according to destination and volume of purchase. The costs described on the website above are estimates and may vary slightly due to the volume of the shipment and increases in transport fees. Please check the shipping cost at the end of the checkout screen where the exact amount will be described.

The delivery times specified are for guidance only and do not take into account possible delays due to payment authorisations or exceptional transport conditions.

CREATING BAGS insures each purchase during the transport process until the order is delivered to the destination address entered by the user. To complete the purchase process all orders must be signed for upon receipt, at which point you become responsible for the items purchased. In the event that you have made a purchase with delivery to another person (e.g. in the case of a gift), you accept as valid the signature at the place of receipt by another person and the responsibility for the items becomes yours in the same way.

Once the order has been invoiced we will send you an email confirming the shipment and your order number for tracking. If you have registered as a user of the online shop you can track your order by accessing your account through the "ACCESS" section. You can also access the information of an order through the access "DIRECT ACCESS TO ORDERS".

8. RETURNS

8.1 RETURN POLICY.

Return shipping costs are free of charge. The return shipping costs are to be paid by the customer.

To return any item of your order you must follow the steps indicated in the section Returns* for the return of the product to our warehouses. You have 14 calendar days from receipt of the order to return the product.

The refund will be made within a maximum period of 3 days from receipt of the items in our warehouses and after verifying that the product has been returned in perfect condition. The refund will be made to the payment method selected at the time of purchase. Shipping costs (if any) will not be refunded.

All items must be returned in perfect condition without having been used, and with the original bags, boxes, labels and packaging. If the returned item is damaged in any way, acceptance of the return may be refused.

All items are quality checked for damage or defects prior to shipment. If you receive an item that is not in perfect condition, please contact us immediately by email info@creatingbags.com.

8.2 REFUNDS

RETURNS POLICY

Any item purchased on CREATING BAGS via our website and customised by the customer with logo/design/text or illustration printing may not request the return or exchange of the product unless there is an obvious and proven manufacturing error, as established in Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of 16 November.

For the return to be accepted by CREATING BAGS, the following requirements must be met:

  • No personalisation (no design/logo printing on any of our products or accessories).
  • Standard manufacture (not custom-made).
  • In the case of defective units, the customer is entitled to return them. The Quality Department will carry out an assessment to determine the cause of the defect, distinguishing between possible manufacturing faults or damage attributable to improper use.
In the event that it is attributable to a failure in the manufacturing process, the corresponding protocol will be activated for the replacement of the affected units. This process will involve the manufacture of new units and their subsequent shipment to the customer.

CREATING BAGS reserves the right to refuse any return, in the event that the above guidelines are not met. Orders that have benefited from a promotion or gift item must be returned in full in order to receive a refund.

Once any return has been refused, the customer will have 3 months to collect and/or collect their order from the central facilities, at their own expense. If the package has not been collected within 3 months, it will be handed over to charity.

CHANGES

We do not exchange models or colours, so if you wish to exchange one item for another, you will have to return the item and make a new purchase with the desired item. Once the return has been received, we will refund the amount using the same payment method.

RETURNS

To make a return, please follow the steps below:

  • Send an email to info@creatingbags.com.
  • It is necessary to specify the order number in the subject of the message.
  • Please also indicate the references of the items you wish to return separated by a comma, mark "RETURN" and explain the reason for the return. Write your comment. It will help us to improve.
  • By sending the email, you AGREE to the conditions of our Returns Policy set out in this Terms and Conditions document.

Once you have received the email from customer service, you will receive a communication on whether or not the return has been accepted. If the return is accepted:

  • It is essential that the package includes all of the above.
  • Cut out the address and stick it on the package so that it is clearly visible.
  • Send the package via the postal service of your choice. Shipping costs will be borne by the customer.

We recommend that you keep a proof of shipment.

REFUND OF THE AMOUNT

Once the item has been received and the return has been approved and authorised, you will receive a confirmation email indicating that the amount of the product(s) to be returned will be paid by the same method of payment used. The initial shipping costs will not be refunded.

The amount will be reflected in your account within approximately 7-15 working days, from the moment you receive the return confirmation email and depending on the conditions of each bank.

RESPONSIBILITY

CREATING BAGS undertakes to deliver your order as soon as possible to the selected transport company. However, CREATING BAGS will not be held responsible for: damage resulting from poor transport, especially for reasons such as industrial action, traffic congestion and in general any other reason typical of the sector resulting in delays, loss or theft of the chosen product. Nor for technical failures which, due to accidental causes or any other type, may prevent the normal operation of the service via the Internet. Nor for the lack of availability of the site for maintenance reasons or any other reason that prevents the user from accessing the service. CREATING BAGS shall use all available means to provide the process of selection, payment and shipment of the desired product. CREATING BAGS declines any responsibility for third party causes, fortuitous circumstances and situations of force majeure.

Likewise, CREATING BAGS shall not be held responsible if, in the case of return, the product suffers any damage derived from the inadequate packaging used by the customer for its delivery to CREATING BAGS, , nor for damage resulting from improper transport directly attributable to the transport company used by the customer to return the product.

Once the return request has been received:

8.3 CANCELLATION OF THE ORDER UNDER THE DSR (DISTANT SELLING REGULATION) STANDARD

According to the DSR Regulation (Distance Selling Regulation), if you have made a purchase from an EU country you have the right to cancel your order by written notice up to 7 working days after receipt of your order. In order to proceed with a return under the DSR regulation you must send us a communication via e-mail to info@creatingbags.com or a formal letter requesting a DSR return, the order number and the items you wish to return to the following address:

If you are availing yourself of the DSR, you will be responsible for the cost of returning the goods under this policy and you must ensure that the means of transport is secure and that the goods are returned to us in good condition to the following address:

For orders cancelled under DSR you will receive a full refund of the cost of the goods and the cost of carriage. Once you have made your request to cancel the order under this policy you will receive an email with confirmation of the return, which you will need to enter in the shipment.

  1. All returned items must be in perfect condition and must not have been used. The return must be made from the same country of receipt of the shipment.

  2. We will reimburse the full cost of your order, including transport costs, within a maximum period of 30 days from receipt of the goods in our warehouses and after checking that they are in good condition.

If you do not wish to use the DSR regulations, you can use our FREE PICK-UP service. To do so, please follow the instructions above.

8.4 DEFECTIVE ITEMS

  1. ITEMS RECEIVED DEFECTIVE

All items are quality checked for damage or defects prior to shipment. If you receive an item that is not in perfect condition, please follow the EXCHANGE OR RETURN REQUEST process described above within 14 days of receipt of your order.

  1. ARTICLES WITH HIDDEN DEFECTS THAT HAVE BECOME APPARENT AFTER USE

There may be hidden manufacturing defects that become apparent after use of the item. Please note that items damaged by wear and tear cannot be considered defective.

If you detect any hidden defects within 6 months of receipt of the item, please contact us by e-mail at info@creatingbags.com. Please attach a description of the problem and, if possible, photographs showing the problem. In the event of a manufacturing defect, we will arrange for the item to be picked up.

The acceptance of a defective product will be carried out after inspection by our technicians upon receipt of the item in our warehouses. In the case of a defective product, it will be repaired if possible. If the repair is not feasible, the article will be replaced with one exactly the same and of the same size. A refund will only be made if the item cannot be repaired or replaced (except for import taxes or duties for Switzerland, Norway, Ceuta, Melilla and the Canary Islands).

9. INTELLECTUAL PROPERTY

The use of the Online Shop and its contents does not confer on the user any right of transfer of ownership of the content (copyright, trademarks, logos, images, graphics, photographs, etc.) including computer code, programs and databases. All content is the property of TODOYUTE, S.L. and is protected by national laws and international intellectual property treaties. Any reproduction, distribution, dissemination or other exploitation of the aforementioned content is strictly prohibited and may result in an infringement of applicable laws.

10. UNAUTHORISED COMMERCIAL USE

This Online Store and its contents are for the personal use of the end consumer. You may not modify, copy, distribute, transmit, reproduce, publish, commercially exploit, transfer, or sell any of the contents, articles or services present in this. It is forbidden to use or exploit this, its contents, products and services for commercial purposes to persons or entities other than TODOYUTE, S.L ....

11. APPLICABLE LAW

The GENERAL CONDITIONS OF USE and any other policy of our Online Store are subject to Spanish law. Any dispute shall be subject to the jurisdiction of the Courts and Tribunals of Elche.
